Remember that little thing called the 4th Amendment?? Well, it has long been under attack and has all but disappeared. 

"The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized."

This is today’s America:
This Fourth of July weekend across the country, police are excitedly announcing that if you don’t submit to a breath test at one of hundreds of unconstitutional DUI checkpoints, they can strap you down by force and take your blood from you without your consent.

From Oregon to Arizona to Louisiana, police have announced that at their DUI checkpoints, if you refuse to take the breath test – which you’re fully within your rights to do, they can detain you until they get a warrant from a judge, then haul you to jail and draw your blood.



The ACLU has reluctantly given their “seal of approval” for the tactics – with a caveat. They argue – and it’s hard to disagree – that these extreme measures don’t make police look good.
The Supreme Court has ruled that – with a warrant – these types of forced blood draws are Constitutional. They’ve also said DUI checkpoints are Constitutional. But that doesn’t mean they’re right.
Subjecting ordinary, innocent to searches and seizures to catch a small minority of scofflaws – no matter how odious the crime – is inherently a violation of the Fourth Amendment.
